Terms and Conditions

1. General

1.1. These terms and conditions of Gift Certificate (hereinafter also the “Conditions”) shall apply to the “Redemption” of Gourmet Cake Jars (hereafter the “Products”) via the private 2025 Grammy Awards Gourmet Cake Jars website (hereafter the “Site”) by users with a Product Gift Certificate and 4-digit redemption code falling within the definition of "Consumers.” The Guest Access area is passcode protected and only Consumers with a Gift Certificate can access the area. The Site, which is the property of Flour House Cakes & Co., with registered office in White Lake, MI and Business Register enrollment (hereafter the “Owner”), is managed by Lincoln Alexander Gibbs.

1.2. On submitting the order, the Consumer agrees that the confirmation of the order information and these Conditions shall be sent by information form on the Site. One submission per Redemption Code.

1.3. Consumers must be aged 18 or over in order to redeem Products on the Site and have legal capacity; the Consumer declares compliance with such requirements.

1.4. The Customer shall not request a return, replacement or reorder. Products are of no cash value to Consumer.  1.5. Consumer has 1 (one) year to redeem their Gift Certificate, not to exceed February 21, 2026.

2. Product features and availability in the various geographical areas

2.1. The Products are gifted by the Owner with the features described on the Site as Classic Vanilla, Salted Caramel, Lemon Velvet and Classic Marble cake, and in accordance with these Conditions published on the Site at the time of the order, excluding all other terms or conditions.

2.2. The Owner reserves the right to amend all or part of these Conditions at any moment in time and at its own discretion, with no obligation to give notice to users of the Site. Any amendments shall come into force from the date on which they are published on the Site, and will only apply to orders concluded from that date onwards.

2.3. The predetermined Product flavors are not exchangeable. Products and/or the characteristics of the same, may be subject to change without notice. Such changes are only applicable to orders which have not been confirmed before the date such changes come into effect. 

2.4 The Site can be accessed from all over the world by authorized users. However, the Products available on the Site can only be ordered by users who request delivery within the United States.

 

3. Product order procedure - Conclusion of each individual order contract

3.1. The presentation of the Products on the Site, which are not binding for the Owner, is merely an invitation to the Consumer to make a contractual offer to order and is not an offer to the public.

3.2. The order submitted by the Consumer to the Owner via the Site shall be a valid contractual offer and is subject to these Conditions, which form an integral part of said order; by placing an order with the Owner the Consumer undertakes to fully accept the same without reservation. Before proceeding with the order of the Products by filling out the information form, Consumers will be asked to read these Conditions carefully. To print off a copy of the same by clicking on the ‘print’ button and to save or keep a copy of the same for their own records. Consumers will also be asked to check and correct any errors in their personal data.

3.3. The Consumer's order is accepted by the Owner by sending an e-mail to the Consumer confirming the order, to the address provided to the Owner during the Site order process; the e-mail will include a summary of the order placed, including a description of the products. The Consumer’s order, the Owner's order confirmation and the Conditions applicable to the contract signed between the Parties will be filed electronically by the Owner’s IT systems and the Consumer may request a copy of the same by sending an e-mail to the Owner at info@flourhousecakes.com.

3.4. Any contract for the order of the Products shall be deemed concluded when the Consumer receives the order confirmation from the Owner by e-mail

 

4. Product and order procedure

4.1. The Products described on the Site are predetermined and can only be ordered by completing the Information Form. The Consumer will be asked to confirm the details (by way of example and not limited to: name, surname etc.) as well as the delivery address for the Products, a telephone number and email for which the Consumer can be contacted in relation to the order made. The Consumer is required to enter the Redemption Code found on their Gift Certificate, carefully read and expressly approve the Terms and Conditions by ticking the relative check box, electronically signing the order form and, finally, confirm the order by pressing the "Place Order" button; this will send the order to the Owner with the consequences illustrated in paragraph. 3.2. of this contract.

5. Delivery and acceptance of goods

5.1. Whilst the Site does not state whether or not Products are available and the relevant delivery times, such information is purely indicative and under no circumstances binding on the Owner.

5.2 The Owner undertakes to do everything within its power to deliver within a maximum of 30 (thirty) days from the day after the Consumer places the order. If the order cannot be processed by the Owner, as the Product ordered by the Consumer is not available, even temporarily, for delivery, the Owner shall notify the Consumer in writing.

5.3. The Products ordered by the Consumer shall be delivered according to the method chosen by the Owner. The Consumer undertakes to promptly check, within and no later than 1 (one) day of receipt of the Products, that the delivery is correct, and to notify the Owner, within this deadline, of any faulty products received or any discrepancy between the order and the goods actually received; failure to do so will infer that the Products shall be deemed as accepted. The Owner is not responsible for any lost, stolen, or damaged Product packages.

 

6. Liability

6.1 Flour House Cakes & Company is not responsible for any damages to the cake caused by a courier service, mail person or any other person not employed by Flour House Cakes & Co. Consumer agrees to make arrangements for a proper and secure environment for the cake.
6.2. Consumer assumes full responsibility for the Products and agrees to indemnify and hold Flour House Cakes & Co. harmless from and against all bodily injury, property damage or consequential damages.
6.3. Consumer assumes full responsibility for making sure all nonedible cake décor, including but not limited to, sugar flowers, acrylic toppers, charms, and packaging are removed from and around the cake before it is consumed. DO NOT EAT DÉCOR.
6.4. Flour House Cakes & Co. products may contain or come in contact with milk, wheat, nuts, cocoa or other allergens. While every precaution will be taken in the cases of known allergies, it remains the full responsibility of Consumers to identify allergens printed on the jars before consumption. Flour House Cakes & Co. is not responsible for any allergic reactions, illness, disability or death associated with consuming our Products.

6.5. Flour House Cakes & Co. promises a product of high quality and service, but is not liable for unforeseen circumstances, including but not limited to inclement weather, transportation problems, illness, accidents, labor disputes or strikes, Acts of God, and other causes beyond reasonable control. A delay in transit (due to the aforementioned circumstances) shall not constitute grounds for a return or replacement.
